Terms of Use

The short version

Be honest. Be respectful. Keep people safe. YEA/NAY lets adults ask anonymous yes-or-no questions and vote on questions submitted by others. Anonymous means other users are not shown who you are; it does not mean Mofako Labs LLC cannot associate activity with an internal account or device for safety, security, moderation, and legal compliance.

1. Agreement to these Terms

These Terms of Use (the “Terms”) govern your access to and use of YEA/NAY, including its mobile applications, websites, features, content, and related services (collectively, the “Service”). The Service is operated by Mofako Labs LLC (“Mofako Labs,” “we,” “us,” or “our”), a Hawaii limited liability company.

By selecting the agreement checkbox, creating an anonymous account, accessing the feed, posting a question, or voting, you agree to these Terms and to the Community Guidelines, which are incorporated into these Terms. You also acknowledge the Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use YEA/NAY. The Service is not directed to children. You may not use the Service if we previously suspended or banned you, unless we expressly restore access.

You represent that the information you provide about eligibility is accurate. We may use age-screening and safety measures permitted by law, but these measures do not replace your responsibility to comply with this section.

3. Anonymous accounts are not untraceable

YEA/NAY may create an internal anonymous account without asking for your public name, email address, or social profile. Other users do not receive your account identifier or identity from us.

To operate and protect the Service, we may associate activity with internal identifiers, session information, IP address, device and integrity signals, questions, votes, skips, reports, blocks, and moderation history as described in the Privacy Policy. We may use this information to prevent spam, ban evasion, fraud, threats, exploitation, and other abuse.

Do not represent YEA/NAY anonymity as secrecy from Mofako Labs, service providers, courts, or lawful authorities. We may preserve or disclose information when reasonably necessary to comply with law, protect a person from serious harm, investigate abuse, or enforce these Terms.

4. What the Service does

YEA/NAY allows eligible users to:

  • submit text questions intended to receive a yes-or-no response;
  • vote yes or no on questions;
  • skip questions;
  • view available voting results;
  • report questions and block anonymous authors; and
  • manage or delete their own account and associated data, subject to lawful retention.

The Service does not provide professional, medical, legal, financial, mental-health, or emergency advice. Votes reflect opinions from participating users and may be incomplete, biased, manipulated, inaccurate, or unsuitable for your circumstances. Do not rely on YEA/NAY results for urgent, dangerous, medical, legal, financial, or safety-critical decisions.

5. Your content

Your Content includes questions, reports, support messages, and other material you submit. You retain ownership of Your Content.

You grant Mofako Labs a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, modify for formatting or safety, display, distribute, and make Your Content available only as needed to operate, secure, moderate, improve, and promote the Service. This license ends when Your Content is deleted from active systems, except for limited copies retained in backups, legal records, safety records, or de-identified data as described in the Privacy Policy.

You represent that you have the right to submit Your Content and that it does not violate these Terms, the Community Guidelines, the law, or another person’s rights. Do not include names, phone numbers, addresses, workplaces, social handles, images, or other details that identify you or another person.

6. Community rules

You must follow the Community Guidelines. Among other things, you may not post or promote:

  • threats, violence, self-harm encouragement, or instructions to cause harm;
  • harassment, bullying, humiliation, stalking, or targeted abuse;
  • hate speech or discrimination based on protected characteristics;
  • sexual exploitation, sexual content involving minors, non-consensual sexual content, or pornography;
  • another person’s personal or confidential information;
  • illegal activity, fraud, scams, trafficking, or exploitation;
  • impersonation, deceptive conduct, spam, vote manipulation, or coordinated abuse; or
  • attempts to evade blocks, suspensions, bans, safety controls, or rate limits.

7. Voting, results, and sharing

Each eligible account may cast no more than one vote per question. Votes cannot be edited after submission unless YEA/NAY expressly introduces that feature. We may reject, reverse, or exclude votes associated with abuse, automation, manipulation, technical error, or policy violations.

Vote counts and percentages may change while a question remains open. We do not guarantee that every question will receive a minimum number of votes or that results represent any population.

If you share a result outside YEA/NAY, people may infer that you asked or voted on the question. Sharing is voluntary. Generated result cards must not expose internal account, device, moderation, or author identifiers.

8. Reporting, blocking, and moderation

You can report objectionable questions and may block an anonymous author. Blocking hides available and future content from that internal author for your account; reporting asks our moderation systems or team to review specific content or conduct.

We may use automated systems and human review to filter, limit, reject, remove, deprioritize, or preserve content. We may warn, restrict, suspend, or permanently ban accounts and devices. We are not required to publish content or explain every moderation decision, but we will provide an appeal path where appropriate.

Reports must be made in good faith. Repeated false or abusive reporting may itself violate these Terms.

9. Safety and emergencies

YEA/NAY is not an emergency service. If you or another person may be in immediate danger, contact local emergency services or an appropriate crisis service. Do not wait for a YEA/NAY vote or moderation response.

Where permitted or required by law, we may preserve and disclose relevant information to emergency services, law enforcement, child-protection authorities, or other appropriate recipients when we reasonably believe disclosure is necessary to address imminent serious harm, child exploitation, or another legal obligation.

10. Service integrity

You may not:

  • access the Service through unauthorized automated means;
  • scrape, crawl, reverse engineer, probe, or disrupt the Service except where law expressly permits;
  • bypass rate limits, moderation tools, device integrity checks, or access controls;
  • introduce malware or interfere with another user’s access;
  • buy, sell, transfer, or share access to an anonymous account; or
  • use YEA/NAY to train a model, build a competing dataset, or commercially exploit content without our written permission.

11. Our intellectual property

The Service, excluding Your Content, is owned by Mofako Labs or its licensors and is protected by intellectual-property laws. YEA/NAY, its visual identity, software, designs, graphics, and related marks may not be copied or used without permission. These Terms grant you a limited, revocable, non-transferable right to use the Service for personal, non-commercial purposes in accordance with these Terms.

Send intellectual-property notices to legal@yeanay.io with enough information for us to locate the material and evaluate the request.

12. Third-party services

The Service may depend on hosting, authentication, analytics, security, crash-reporting, notification, and app-store providers. Their services may be governed by separate terms. We are not responsible for third-party services outside our control, but we remain responsible for selecting providers and handling information as described in the Privacy Policy.

13. Changes and availability

We may change, suspend, or discontinue part or all of the Service. We do not guarantee uninterrupted access, permanent storage, a particular number of questions, votes, or users, or that a feature will always remain available.

We may update these Terms. If a change materially affects your rights or obligations, we will provide notice in the Service and request renewed acceptance where required. The version and effective date will appear at the top.

14. Account termination and deletion

You may request deletion through More → Settings → Privacy Policy → Delete My Data after your anonymous account has been created, or through https://www.yeanay.io/delete-account.html if you no longer have the app.

We may restrict, suspend, or terminate access if you violate these Terms, create risk or legal exposure, repeatedly infringe rights, or threaten the safety or integrity of the Service. We may retain limited information after deletion or termination when reasonably necessary for security, fraud prevention, legal compliance, dispute resolution, or enforcement, as explained in the Privacy Policy.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” MOFAKO LABS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT USER CONTENT, VOTES, RESULTS, OR MODERATION DECISIONS ARE COMPLETE, ACCURATE, SAFE, OR ERROR-FREE.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOFAKO LABS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, PERSONAL DISTRESS, OR LOSS ARISING FROM USER CONTENT, VOTES, RESULTS, OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

17. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mofako Labs from claims, liabilities, damages, losses, and reasonable expenses arising from Your Content, your misuse of the Service, or your violation of these Terms, the Community Guidelines, law, or another person’s rights.

18. Disputes

Please contact us first at the email address below so we can try to resolve any concern informally. Nothing in these Terms limits any rights you have under mandatory consumer-protection law.

19. General terms

If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets. These Terms, the Community Guidelines, and referenced policies form the entire agreement regarding the Service.
